What it does

The rule in brief

The Bill makes data centre services an essential service under the NIS Regulations 2018. Third-party data centres are in scope at a rated IT load of 1 MW or more, and enterprise data centres (run only for the owner's own IT) at 10 MW or more. Operators must notify Ofcom, put proportionate security and resilience measures in place and report significant incidents: an initial notice within 24 hours and a full report within 72 hours. Ofcom can direct interim measures and impose penalties, including daily fines. Managed service providers are brought in too, regulated by the Information Commission.
