EU Foreign Investment Screening Regulation
Every Member State must screen foreign investment in a common set of sensitive sectors from January 2028.
Adopted, not yet applying Regulation (EU) 2026/1386 of 17 June 2026 replaces Regulation 2019/452 and fully applies from 17 January 2028.
What it does
The rule in brief
The new regulation requires every Member State to have a screening mechanism covering a common minimum scope of sensitive sectors, and reaches investments made through foreign investors' EU subsidiaries. It replaces the 2019 framework, which stays in place until the new rules apply.
