What it does
The rule in brief
The order declares a national emergency over the bulk-power system and prohibits the acquisition, importation, transfer or installation of foreign-produced bulk-power system electric equipment where a foreign country or national has an interest and the transaction meets the order's risk criteria, as determined by the Secretary of Energy. The equipment list includes substation transformers, inverters, battery storage, uninterruptible power supply systems supporting critical infrastructure, backup generators, circuit breakers and generation turbines. The order cites the growth of data centres and AI. On 9 September 2026 the Department of Energy asked for information on the scope of covered equipment and transactions, existing equipment and mitigation, and licensing and prequalification, with responses due by 9 October 2026.
