What it does

The rule in brief

The order defines a Data Center Project as a facility needing more than 100 MW of new load for AI inference, training, simulation or synthetic data generation. Qualifying Projects include those with at least $500 million of committed capital expenditure or more than 100 MW of incremental load. Commerce is to launch an initiative of financial support (loans, loan guarantees, grants, tax incentives and offtake agreements), agencies are to use and create NEPA categorical exclusions, and federal and brownfield land is to be made available.
